[ NOTE: In former Yugoslavia (SFRJ) the private flats were (de iure and de facto) seized from original owners (even those who remained registered in the cadastral books), and practically all the rights were given to tenants forever. Today some tenants are discriminated against and deprived of their legally and honestly acquired tenantship rights.
---- Za vrijeme SFRJ privatni stanovi su bili (de iure i de facto) oduzeti od izvornih vlasnika (cak i onih, koji su ostali upisani u zemljisnim knjigama), a stanari su zauvijek dobili prakticki sva prava. 10. "The Assembly advises that property, (......), which was illegally or unjustly SEIZED by the state, NATIONALIZED, confiscated OR OTHERWISE expropriated during the reign of communist totalitarian systems in principle be RESTITUTED to its original owners IN INTEGRUM, IF THIS IS POSSIBLE WITHOUT VIOLATING (......) THE RIGHTS OF TENANTS WHO RENTED THE PROPERTY IN GOOD FAITH (......). In cases WHERE THIS IS NOT POSSIBLE, JUST MATERIAL COMPENSATION SHOULD BE AWARDED. (......)."

REMARK (by B. Soric): In SFRJ the property has been seized in various ways, e.g.: it was nationalized, or confiscated, or a permanent and forever-inheritable tenantship right has been given to tenants in private flats BY THE LAW (in many cases this was done against the owners' will, whereby the reliability of cadastral books, as proofs of complete ownership on such flats, has forever been derogated); and so the original owners have forever lost almost all the property rights on such flats. _ (In some cases, an original owner has given, of his own free will, the tenantship right to a tenant. - Of course, in such cases the property has not been seized, and so it must not be returned or given to the owner's inheritors).

Stavak 10: "Nadalje, Skupstina savjetuje da imovina, (......), koja je bila nezakonito ili nepravedno ODUZETA od strane drzave, nacionalizirana, konfiscirana ili na drugi nacin ekspropriirana za vrijeme vladavine komunistickih totalitarnih sistema, u principu treba biti restituirana izvornim vlasnicima in integrum, AKO je to moguce uciniti BEZ KRSENJA (......) PRAVA STANARA koji su unajmili tu imovinu u dobroj vjeri (......). U slucajevima KADA TO NIJE MOGUCE, TREBA SE DODIJELITI PRAVEDNA MATERIJALNA NAKNADA. (......)."

NAPOMENA (B. Soric): Za vrijeme SFRJ imovina je bila oduzeta na razne nacine, na pr. konfiskacijom, nacionalizacijom, davanjem trajnog i zauvijek nasljedivog stanarskog prava stanaru i to zakonom (u mnogim slucajevima protiv volje izvonog vlasnika, bez obzira na zemljisne knjige koje su time derogirane), pa je time izvorni vlasnik zauvijek izgubio gotovo sva vlasnicka ovlastenja (prava) nad stanom. _ (Jasno, ako je vlasnik sam dao stanarsko pravo stanaru, onda imovina nije oduzeta od vlasnika, pa se niti ne vraca).

------ "(......) u toj kategoriji tih vlasnika stanova jedan dobar dio su prekupci; dakle ne izvorni vlasnici stanova koji su gradili te stanove, nego koji su te stanove kupili prije 40, 50 _ kad su se mogli kupovati stanovi, i ti prekupci su jos najgori. Jer naravno oni zele brzo i efikasno ostvariti vrijednost tih stanova (......) pokusavaju izbaciti te stanare, prema tome vidite, mislim da bi trebali svi ovdje zastupnici, sve ove stranke nase, da razmisle o toj kategoriji stanara, i da se dopusti, i kao sto je to u Ceskoj napravljeno, svima otkup stanova. A drzava je zato tu da vlasnicima stana na ovaj ili na onaj nacin nadoknadi. - Ovim prekupcima, to je posebna i najteza kategorija, najkriminalnija kategorija, ti prekupci koji sada sudski istjeruju te gradjane, stare, koji su 45 godina, sada vec i 50, u tim stanovima (......)".

---- "(....) - In the category of owners a considerable part are middlemen (resellers) (.....) and they are the worst. Because, of course, they want to realize the value of those flats quickly and effectivly. (....) They try to drive out the tenants; - so, I think that ... all (tenants) should be allowed to buy the flats, as it has been done in the Czech Republic. And the State (....) should compensate the owners in one way or another.
---- These middlemen (resellers) are a special and most difficult category, the most criminal category, - they now drive out those old citizens, who have been in these flats for 45, or now even 50 years. (......)".

---- "(....) - Some tenantship-right holders have been discriminated against, who were denied the right to privatization of flats on which they had QUITE EQUAL TENANTSHIP RIGHTS as many others, who were granted the opportunity to buy their flats on very favourable terms. (.......)
---- SDP (the Social-Democratic Party) has always pleaded for the solution by which all (tenants) should be allowed to buy the flats on equal terms, and the owners should be awarded the compensation of the market value (of flats). I emphasize THE MARKET VALUE, in order that our proposals should not be misinterpreted later on.
----The point of support for such a position is found tn the Croatian Constitution, in Article 50., which provides that ownership can be restricted or seized in the interest of the Republic of Croatia. At the same time, our informations and talks with the parties concerned show that such a solution would be accepted by a great majority of owners too, because they also see that this proposal is a way to get out of their unsatisfacoty state. ---- "(....) .... uveli smo diskriminaciju nad nekim nositeljima stanarskog prava kojima je osporeno pravo privatizacije stana na kojem su imali stanarsko pravo potpuno jednako kao i mnogi drugi kojima je pruzena prilika da pod znacajno povoljnijim uvjetima svoj stan otkupe. (......)
---- Rjesenje opisanog konflikta koje smo duzni zakonom osigurati biti ce dobro tek kad prihvatimo nacelo da ni stanari ni vlasnici ne smiju biti zrtve tudjih pogresaka, pogresaka nekih drugih ljudi ili nekih drugih sistema, znaci kako onih iz proslosti, ali tako i onih koji danas zastupaju princip, ja bih rekla, sto gore to bolje, ili jednostavno princip: sto me briga za tudje probleme, glavno da nisu moji.
---- SDP se oduvijek izjasnjavao kao zagovornik rjesenja po kojima svim stanarima treba pod istim uvjetima omoguciti otkup stana, a vlasnicima osigurati trzisnu naknadu. Naglasavam trzisnu naknadu, kako poslije ne bi bilo nekih krivih interpretacija nasih prijedloga.
---- Uporiste za takav stav nalazi se i u hrvatskom Ustavu u clanku 50. gdje je propisano da se vlasnistvo moze ograniciti i oduzeti kada je to u interesu Republike Hrvatske. Istovremeno ocjenjujemo na temelju nasih informacija i razgovora sa zainteresiranim stranama da bi takvo rjesenje prihvatila i velika vecina vlasnika, jer i oni u tom prijedlogu vide izlaz iz svog nezadovoljavajuceg stanja.
